(Oral) Petitioner herein, who at present is working as Lecturer (School New Economics), is aggrieved by order dated 22.08.2025 (Annexure P-2), whereby she has been transferred from GBSSS Nahan, District Sirmaur, Himachal Pradesh to GSSS Malat, Shimla, Himachal Pradesh, vice respondent No.3. 2. Precisely, the grouse of the petitioner, as has been highlighted in the petition and further canvassed by Mr. P.P. Chauhan, learned counsel representing the petitioner, is that within 24 hours of issuance of order dated 21.08.2025 (Annexure P-1), whereby petitioner, after his promotion to the post of Lecturer sent to GBSSS Nahan, District Sirmaur, Himachal Pradesh, has been further transferred to GSSS Malat, Shimla, Himachal Pradesh, which action of the respondents is in violation of the Transfer Policy. 3. Pursuant to notices issued in the instant proceedings, respondents No.1 & 2 have filed reply under the affidavit and signatures of Director School Education, Himachal Pradesh. Though an attempt has been made to justify the impugned transfer, but it has been further stated that petitioner’s order, which is under challenge, was modified to transfer him at GSSS Toka Nagla, Sirmaur, Himachal Pradesh, against vacancy caused due to the retirement of present incumbent on 31.08.2025, as per approval of the competent authority accorded on 27.08.2025, but same could not be implemented as the Government of Himachal Pradesh has decided that teachers/teaching faculty posted in Government Educational Institutions under the Education Department of the State Government shall be sessional re- employed for the ongoing academic session 2025-26, in accordance with the criteria mentioned in the notification of Finance Department to the Government of Himachal Pradesh. 4. Mr. Vishal Panwar, learned Additional Advocate General, taking note of aforesaid assertions made in the reply, states that petitioner shall be sent to GSSS Toka Nagla, Sirmaur, after completion of academic session 2025-26, which proposal is acceptable to learned counsel for the petitioner. Mr. P.P.Chauhan, learned counsel for the 2 petitioner, states that petitioner shall be satisfied, in case directions are issued to the respondents to transfer her to GSSS Toka Nagla, Sirmaur after completion of academic session 2025-26. 5. Consequently, in view of the above, present petition is disposed of with a direction to the respondents to the pass order, thereby transferring the petitioner to GSSS Toka Nagla, Sirmaur, Himachal Pradesh from the GSSS Malat, Shimla, Himachal Pradesh, after completion of academic session 2025-26 forthwith, stipulating therein petitioner shall join at transferred station after completion of academic session 2025-26 and retirement of the incumbent.
