Issue writ of mandamus or any other appropriate writ or direction quashing Impugned recommendation in Kra:DVS.MSC:CR:76/2023/230653/F6 dated 13.11.2024 of Respondent No.2 as per ANNEXURE- A and all further action pursuant to ANNEXURE-A., in the interest of justice and equity. b. Grant such other and further relief deems fit by this Hon'ble court in the facts and circumstances of the case." 2. Heard the learned counsel Sri.Ajay Prabhu M., appearing for the petitioners., the learned Additional Government Advocate Smt. Prathibha R.K., appearing for respondent Nos.1 to 5 and the learned counsel Sri. K.Ravishankar, appearing for respondent No.6. 3. Facts in brief, germane, are as follows: - 4 - NC: 2025:KHC:13790 WP No. 34468 of 2024 The petitioners are said to be belonging to Jain community and the forefather’s of the petitioners are said to be maintaining and managing the temple - Shri. Vishnumurthy Temple Kalenja situated in Denthadka, Biliyoor village, Perne post, Bantwal Taluk (hereinafter referred to as ‘the temple’ for short). The temple is said to have been constructed in the 15th Century by the forefather’s of the petitioners belonging to Kalenja Guttu and Patte Guttu. For the purpose of maintenance and proper management of the temple, the petitioners have included the family members of other castes in the village by constituting a trust, on 27.01.2023. 4. When things stood thus, the forth respondent - Supervisor I Grade in the department of the Religious and Charitable Endowments issues a notice to the petitioners seeking to appoint an administrator to administer the temple, on 28.02.2023, notwithstanding the fact that it is not a notified temple, under the provisions of the Karnataka Hindu Religious Institutions and Charitable Endowments Act, 1997 (hereinafter referred to as ‘the Act’ for short). The petitioners submit their reply on 07.03.2023. Notwithstanding the reply, the fourth - 5 - NC: 2025:KHC:13790 WP No. 34468 of 2024 respondent recommends to the competent authority to declare the temple to be a declared institution under Section 42 of the Act. Based on the said recommendation, a show cause notice comes to be issued by the third respondent – Assistant Commissioner of the Department of Religious Institutions and Endowment Fund seeking to show cause as to why the temple should not come under the ambit of the Act, on 03.04.2023. 5. The petitioners submit their reply and the averment in the petition is, owing to pressure from the political circles, the reply of the petitioners is not considered and the impugned recommendation on 13.11.2024, declaring the temple as a declared institution is passed. It is this that has driven the petitioners to this Court in the subject petition. 6. The learned counsel Sri.Ajay Prabhu M., appearing for the petitioners would submit that the Trust was registered on 27.01.2023 and the people who are inimical to the formation of the Trust register a complaint 20 days after its formation and the State has taken up the proceeding under Section 42 of the Act. The learned counsel would submit that - 6 - NC: 2025:KHC:13790 WP No. 34468 of 2024 Section 42 of the Act cannot spring into action at all in the case at hand and therefore, seeks quashment of the entire proceedings. 7. The learned Additional Government Advocate appearing for the State would submit that infact the proceedings that were taken up by the Deputy Commissioner was erroneous and therefore, the matter has been remitted back to his hands to hear the petitioners and then pass necessary orders in accordance with law. She would submit that the petition is premature and the petitioners will have to participate in those proceedings before the Deputy Commissioner, as is directed by the Commissioner today. 8. The learned counsel, Sri.K.Ravishankar representing the 6th respondent would also toe the lines of the learner Additional Government Advocate contending that violation of principles of natural justice or violation of Subsection (6) of Section 43 of the Act has led the Deputy Commissioner to redo the exercise. I have given my anxious consideration to the contentions of respective learned counsel and have perused the material on record. 10. The afore-narrated facts are all a matter of record. The temple which is the subject matter of the petition is of 15th Century, this is an admitted fact. A Trust is formed for maintaining and managing the temple on 27.01.2023, is again a matter of record. Barely, twenty days thereafter, a complaint comes to be registered by the sixth respondent. The complaint alleges mismanagement of the temple in 20 days of its functioning. Based upon the complaint, a notice is issued by the fourth respondent on 28.02.2023. Bಾ. ಸಂ. ಮತು; ದ ದ;ಗಳ ಇ6ಾ7ೆ, ದ.ಕ. ಮಂಗಳDರು.” (Emphasis added) The issue in the lis is, whether the procedure stipulated in law has been followed or otherwise. 11. Since the temple is declared under Section 42 of the Act and a show cause notice is issued under Section 43 of the Act, I deem it appropriate to notice Sections 42 and 43 of the Act. They read as follows: “42. Declared Institutions.- The State Government may, where it is satisfied on a report of the Commissioner under section 43 or otherwise that any Hindu Religious Institution, whether or not governed by a settled scheme, is being mismanaged, declare such institution to be subject to the regulation of this chapter. Provided no such declaration shall be made without following the procedure hereinafter specified. 43. Notice to show cause.- (1) Where the Commissioner has reason to believe that a Hindu Religious Institution whether or not governed by a settled scheme is being mismanaged and he is satisfied that in the interest of its administration, it is necessary to take proceedings under this chapter, he may, by notice published in the prescribed manner, call upon the Manager and all other persons having interest, to show cause why such institution should not be declared to be subject to the provisions of this Chapter. (2) Such notice shall state the reasons for the action proposed and specify a reasonable time, not - 16 - NC: 2025:KHC:13790 WP No. 34468 of 2024 being less than one month from the date of issue of the notice, for showing such cause. (3) The Manager or any person having interest may thereupon prefer his objections, if any, to the issue of a declaration under this chapter. (4) Such objections shall be in writing and shall reach the Commissioner before the expiry of the time specified in the notice aforesaid or within such further time not exceeding forty five days on the whole as may be extended by the Commissioner. (5) Where no objections are received within the time so specified or extended, the State Government may, on receipt of a report from the Commissioner to that effect, by a notification published in the official Gazette declare such Hindu Religious Institution to be subject to the provisions of this Chapter. (6) Where objections are received within the time so specified or extended, the Commissioner may authorise any officer subordinate to him to hold an enquiry into the objections in the manner prescribed who shall after giving the Manager or any person having interest an opportunity of being heard submit his enquiry report to the Commissioner as to whether or not the Institution should be declared to be subject to the provisions of this Chapter. (7) After considering the enquiry report referred to in sub-section (6), if the Commissioner decides that the Institution should be declared as aforesaid, he shall make a report to that effect to the State Government, which may, by notification declare such Hindu religious Institution to be subject to the provisions of this Chapter. (8) Every Notification issued under sub-section (5) or (7) shall remain in force for such period as may be specified therein and which may be extended further, so however that the total period shall not exceed five years from the date of the first notification, or till a new Committee of Management is formed to the satisfaction of the State Government whichever is earlier. - 17 - NC: 2025:KHC:13790 WP No. 34468 of 2024 (9) Where a new Committee is formed to the satisfaction of the State Government, the State Government may on its own or on the report of the Commissioner direct the Executive Officer appointed for the institution to handover the management of the Institution to the new committee of management." (Emphasis supplied) Section 42 of the Act mandates that ‘the State Government may, where it is satisfied on a report of the Commissioner under Section 43 of the Act or otherwise that any Hindu Religious Institution, whether or not governed by a settled scheme, is being mismanaged’. The soul of the provision is that, the Institution should be mismanaged. Once it is prima facie found that it is mismanaged, a notice to show cause on the said report is to be issued to the person, who is going to be affected by any order that would be passed, as obtaining under Subsection (6) of Section 43 of the Act. 10. The issue in the lis is, there is no foundational report of any mismanagement before the Deputy Commissioner or the Commissioner as the case would be. What is in the hands of the State is, a complaint registered by the 6th respondent barring that, there is not even a titter of material - 18 - NC: 2025:KHC:13790 WP No. 34468 of 2024 before the State that the Institution is being mismanaged. Within 20 days of the formation of the Trust, the State appears to have been gone into the complaint of the 6th respondent that the Institution is likely to be mismanaged by the petitioners. In apprehension / suspicion, a proceeding under Section 43 of the Act to declare an Institution under Section 42 of the Act cannot spring. The State has acted in undue haste to issue notices and initiate proceedings under Section 42 of the Act. All owing to a complaint of the 6th respondent, without there being any other material. 11. Thus, the submission of the learned counsel for the 6th respondent and the State that the proceedings are now instituted by the State in compliance with Subsection (6) of Section 43 of the Act and therefore, the petition should not be entertained, does not merit any acceptance. If the State had laid a foundation as obtaining in the statute to declare any institution to come within the ambit of the Act, it would have been altogether a different circumstance. The Trust to manage the temple so constituted was barely twenty days old for any mismanagement. In anticipation of a suspected mismanagement, if proceedings under Section 42 of the Act is - 19 - NC: 2025:KHC:13790 WP No. 34468 of 2024 taken, it would on the face of it, become an abuse of the process of the law. The entire proceedings of the State suffers from want of bonafides and in the result, the proceedings are to be held unsustainable. 12. For the aforesaid reasons, the following: ORDER i) The writ petition is allowed. ii) The impugned recommendation in Kra:DVS.MSC:CR:76/2023/230653/F6 dated 13.11.2024 of respondent No.2 stands quashed. iii) All consequential action taken / if taken, pursuant to the recommendation, are all held nullity in law.
