---- 03/20.11.2025 Heard learned counsel appearing for the petitioners as well as the learned counsel appearing for the State.
2. The petitioners are apprehending their arrest in connection with Chainpur P.S. Case No.118 of 2025, for the alleged offences registered under Sections 103(1), 238 and 3(5) of Bharatiya Nyaya Sanhita, 2023 and Section 3 of Child Labour (Prohibition and Regulation) Act, pending in the Court of learned Sub-Divisional Judicial Magistrate, Palamau.

Learned counsel appearing for the petitioners submits that the allegations are made that the petitioners have taken three

children to Mohammadganj Railway Station where they were engaged in a restaurant. He further submits that the allegations are made that one of the children died after a month and his body was brought to the village by Administration. He then submits that the case diary has been called for by the earlier order which has been received and in the case diary the cause of death is not disclosed. He also submits that the viscera has been preserved and the report is there that there is no internal and external injury.

Learned counsel appearing for the State opposes the prayer and submits that the allegation is there against the petitioner of keeping the dead body at the door of the administration and fled away.

Considering that the allegation is made against the petitioners that they have taken the three children to Mohammadganj Railway Station and they were engaged in a restaurant and it has been further alleged that the dead body of one of the children was brought by the petitioners and kept at the gate of District Administration and thereafter they fled away. In the attending facts and circumstances, I am not inclined to grant anticipatory bail to the petitioners, hence, the prayer for anticipatory bail of the petitioners is hereby rejected.
