Petitioner/Accused-2 AND The State of Andhra Pradesh, Rep. by its Special Public Prosecutor, CID, High Court Buildings, Amaravathi. Respondent/Complainant Petition under Sections 482 of BNSS (old 438 of Cr.P.C), praying that in the circumstances stated in the affidavit filed in support of the Criminal Petition, the High Court may be pleased to enlarge the petitioner on bail in the event of his arrest in FIR No.25/2024 on the file of CID Police Station, A.P, Mangalagiri in the interest of justice. The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of Sri RAJA REDDY KONETl, Advocate for the Petitioner and of PUBLIC PROSECUTOR for the Respondent and the Court made the following;

"F5Z¥H ETITIO N NO: 9773/2024 The Criminal Petition, u/Sec`.482 of the Bharatiya Nagarik Suraksha sanhita, 2023, is filed on behalf of the Petitioner/A2 to grant anticipatory bail in connection with crime No.25/2024 of C.I.D. Police Station, Mangalagiri. 2) A case has been registered against the Petitioner and Others for the offences punishable under Sections 420, 409, 468, 471 read with 120B IPC and sectl'on 13(2) of the P.C.Act, 1988. 3) Case of the prosecution in briefiSthat: The branch head of Union Bank of India, Brodipet branch, Guntur gave a report alleging that five persons, who are Al to A5, worked in the branch. As per the said report, the regular auditor Of the branch found irregularities in sanction and disbursement self help group (SHGCC) and related savI-ng accounts Of the groups. The bank conducted investigation and found siphoning of funds by transferring the amounts to saving account of different individuals, material alterations enhancing the limits without following SHG guidelines, Crediting the loan amount to group saving account instead of individual saving accounts, keeping part of the loan amount in saving account for future adjustment etc.
Some of the cheques related to Government sponsored schemes and issued in favour Of Other SHG group •- GFE4-
were transferred to individual saving accounts wl'thout verifyI'ng the genuineness of the payee. The enqul'ries made by the investigating officer revealed that irregularities were deliberately comml-tted. when the transactions were placed before the fraud monitoring group, the transactions/incidents were classI-fled as fraud. It was also found that serI-OuS I'rregularities were observed in creditI-ng Of Pasupu Kumkuma (scheme by Government) cheques in sav[-ng accounts of 43 self help groups. The jrregularI'tI-eS found were that the amount received was directly credited to indivI'dual accounts without any authentI-Call-On for the corrections made on the cheques. Instead of crediting the amounts to SHG group accounts and there from to the individual accounts, the amounts were credited to indI'Vidual accounts directly. 4) Heard. Perusedtherecord. 5) A perusal of the material available on record goes to show that they were not due diII'gent l'n discharging their duty. Except the sal'd accusation, there is no other accusation i.e. as agaI®nSt the Petitioner herein. Apart from that, the petitioner is aged about 64 years. In vI'eW Of the aforesaid circumstances, this court is inclined to grant the prayer of the petl'tI'Oner/A2 for grant of anticl'patory bail. tier qae pF-
6) Accordingly, in the event of his arrest with regard to this crime, petitioner/A2 shall be released on bail on his executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only), with two sureties for the like sum to the satisfaction of the arresting police officials and also on condition that the petitioner shall make himself available for investigation as and when required and that he shall not cause any threat, inducement or promise to the prosecution witnesses. The petitioner shall appear before the station House Officer concerned, once I-n a week i.e. on every Sunday between 10.00 a.m. and 05.00 p.m., till filing of the charge-sheet. 7) Accordingly, the Criminal Petition is allowed.
