The petitioner has been filed this writ petition on the following relief(s) : “10.1 That this Hon'ble Court may kindly be pleased to quash the impugned order dated: 28.06.2024 passed by the District Education Officer, Jashpur (C.G.). 10.2 That, the Hon'ble Court may kindly be pleased to direct the respondent authorities to hand over the management of the Ken Memorial Higher Secondary School Mudapara, Block: Pathalgaon, District: Jashpur (C.G) to the petitioner society. 10.3 That, the Hon'ble Court may kindly be pleased to direct the concerned respondent authority to decide the representation dated: 08.07.2024 at the earliest preferably within a period of 30 days. 10.4 That, the Hon'ble Court may kindly be pleased to grant any other order that may be deemed fit and just in the facts and circumstances of the case including awarding of the costs to the petitioner.” 2. Counsel for the petitioner contended that being aggrieved by the grievance the petitioner society preferred a representation dated: 3 / 4 08.07.2024 before the Collector, Jashpur (C.G.) stating the grievance with respect to arbitrarily handing over the management of the school to TEAMS society and inter-alia requested for quashing of the same and handing over the management back to the petitioner society, but till date the aforesaid representation has not been decided by the concerned authority (Collector) and the petitioner society has to run from pillar to post for redressal of their grievance, therefore, it is prayed that the petitioner may be permitted to submit fresh representation before Respondents No.2 & 3 by raising all grievances as raised in the petition and in-turn Respondents No.2 & 3 may be directed to consider and decide the same at the earliest within specified time framed. 3. Learned State Counsel not opposes the limited prayer made by counsel for the petitioner. 4. I have heard learned counsel for the parties and perused the documents with utmost circumspection. 5. Considering facts of the case, submissions of counsel for the respective parties, this writ petition is disposed of permitting the petitioner to submit fresh representation before Respondents No.2 & 3 within '15 days' from today raising all grievances as raised in this writ petition. On making such representation, Respondents No.2 & 3 shall consider 4 / 4 and decide the same, as expeditiously as possible as per relevant rules, regulations and law. 6. It is made clear that this Court has not expressed any opinion on the merits of the case and the authorities shall not be prejudiced by any observation made by this Court and shall decide the case of the petitioner on its own merits.
