GP FOR FINANCE PLANNING The Court made the following: ORDER:- This Writ Petition is filed by the petitioner, under Article 226 of the Constitution of India seeking Mandamus, for the following relief: “…to issue a writ of mandamus or any other appropriate writ direction declaring the action of the Respondents in withholding the undisputed bill amounts payable to the petitioner in respect of work i.e., Laying of CC Roads and CC Drains at D.No.50-64-25/10 to 50-64-25/11A and EP No.158/B1/12 to D.No.50-64-28/35 BTR Colony in Relliveedhi in 1086133 Sachivalayam in Ward No.25 of Zone-III vide Agreement No.166/2023-24/EE-lll/DB dt 22.09.2023, even after finalizing the bills as illegal, arbitrary and contrary to the Principles of natural justice and consequently direct the respondents to pay undisputed bill amount of Rs.12,75,851/- payable to the petitioner in respect of execution of afore mentioned work vide Agreement No.166/2023-24/EE-lll/DB, dt.22.09.2023 along with interest @ 18% p.a. from the date of recording of bills forthwith…” 2. Today when the matter came up for hearing, Mr.ASC Bose, learned Standing Counsel representing respondent Nos.4 to 6, has furnished a copy of instructions of respondent No.6, wherein the it is stated that the measurements were recorded and bill was raised for gross amount of Rs.12,75,851/- and net amount of Rs.11,42,587/- and uploaded in CFMS portal with the token number 2023-2076664, which is awaiting from the fund clearance from the Government of Andhra Pradesh. 3. In view of the same, instead of keeping the writ petition pending, this Court is of the opinion to dispose of the writ petition by directing respondent No.7 to clear the said bills, as expeditiously as possible, preferably within a period of three (3) months, from the date of receipt of copy of this order. 4. Accordingly, the Writ Petition is disposed of. No order as to costs.
