The petitioner being complainant filed the present petition with the prayer to direct the respondent No.2/District Magistrate, Moradabad to conclude the final inquiry and pass final order against Gram Pradhan. 2. Today when the matter is taken up, a preliminary objection has been raised by the learned Standing Counsel that in view of the law laid down by this Court in the case of Birjlal @ Brij Bahadur Vs. State of U.P. and others reported in (2016) UPLBEC Page 1861 the complainant has no role to approach this Court under Article 226 of the Constitution of India. 3. At this stage, a prayer has been made by learned counsel for the petitions to dismiss the present petition as withdrawn with liberty to approach the authority. 4. This prayer has not been opposed by learned counsel for the respondent. 5. Accordingly, the present petition is dismissed as withdrawn with liberty as prayed.
