1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 0268/2025 registered at Police Station – Kharora, District - Raipur (C.G.) for the offence punishable under Section 105 of BNS,2023.
2. Learned counsel for the State has pointed out that a bare perusal of the impugned order dated 02.07.2025, against which the present VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.07.25 20:19:14 +0530
2 anticipatory bail application has been filed, would show that the learned trial Court has not rejected the bail application of the applicant on merits, indeed, it has been dismissed as withdrawn. Therefore, the present bail application is not maintainable against the said order of withdrawal.
3. Faced with this, learned counsel for the applicants seeks permission to withdraw this application with the liberty to file afresh after adopting due procedure.
