Applicant is the husband against whom his wife has moved an application for maintenance under Section 144 of Bhartiya Nagarik Suraksha Sanhita, 2023. Applicant has sought transfer of said application from Family Court, Chamoli to Family Court, Rudraprayag. 3. Mr. Jayvardhan Kandpal, learned counsel appearing for respondent submits that application for transfer of proceedings initiated under B.N.S.S of 2023 would not be maintainable under Section C24 CPC and such prayer can be made only by invoking the relevant provision contained in Bharatiya Nagarik Suraksha Sanhita, 2023. 4. This Court finds substance in the said submission. 5. Since Section 24 CPC can be invoked only for transfer of civil cases from one Court to another, therefore, this Application is not maintainable for transfer of proceedings under B.N.S.S of 2023. 6.
