THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE MOHAMMAD NAWAZ ORAL ORDER This petition is preferred praying to enlarge the petitioner on bail in Cr.No.394/2024 of Govindaraja Nagar Police Station registered for offence punishable under Section 109 of BNS, 2023. 2. Heard the learned counsel for petitioner and the learned High Court Government Pleader for respondent/State and perused the material on record. 3. It is the case of prosecution that on 11.11.2024 at about 7.15 – 7.30 p.m., the victim had parked his autorickshaw in front of a bakery in 4th cross, Subbanna Garden. The accused who was on a two wheeler hit the autorickshaw from behind. A verbal quarrel took place - 3 - NC: 2025:KHC:2017 CRL.P No. 50 of 2025 between the two. Accused took a knife and stabbed the victim on the abdomen, left hand and fisted him on his face and on seeing the public approaching, fled away. 4. Petitioner’s counsel would contend that the incident was not premeditated. As a result of a petty accident, a sudden quarrel took place and in the said quarrel, some injuries are caused. He contended that the petitioner is in judicial custody from 12.11.2024 and the injured has been discharged from the hospital. 5. Learned High Court Government Pleader has contended that the injured has sustained grievous injuries and investigation is under progress. 6. The material on record would reveal that the petitioner was in possession of a knife when the incident took place. It is true that the incident was a result of a quarrel, which ensued after a petty accident. However, the petitioner has stabbed on the abdomen of the injured with a knife. The said injury as per medical records is grievous in nature. Since investigation is still under - 4 - NC: 2025:KHC:2017 CRL.P No. 50 of 2025 progress, at this stage, this Court is of the view that this is not a fit case to enlarge the petitioner on bail.
