THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY ±NA L P ET [I!Q±!±!Q±Z±±£E_2!24 ORDER: This Criminal Petition, u/Sec.482 of the Bharatiya Nagarik suraksha sanhita, 2023, has been filed by the Petitioners/A2, A4, A5, A6, A12, A17 and A20, seeking antiCiPatOry bail, in Crime No'269/2024 of Amaravati Police Station, Palnadu district- 2- A case has been registered against the Petitioners herein and others for the offences punishable under sections 351(2), 118(1)I 109(1)I 189(2),189(4) and 190 of the Bharatiya Nyaya Sanhita, 2023 (for short {BNSj).
3, Thecaseofthe prosecution, in brief, iSthat: on 12,ll.2024, at about 7.30 pm, When the de faCfo complainant along with three others namely TirumallaSetty sambasiva, perumalla Ramaiah and Rajyaiah Stood at Ranga statue, all the accused attacked and beat them indiscrim'lnately uttering words as llchampandi", as a result, the de facfo complainant sustained bleeding injury over the nose and swelling injury on either sides. The above Said three Persons also sustained bleeding injuries. when the relatives of the de facfo G,ZZZZZZ,
2 // complaI'nant raised cries, a" the accused fled away by threatenI-ng to do away thel®r lives. 4. Heard. Perusedtherecord. 5. It is submI'tted by the learned counsel for the petI'tiOnerS that there is a dI-SPute between the de facfo complainantJs party and the accused party, and case and counter cases were registered against each other. He further submitted that the complaI'nt given by the petI'tiOnerS hereI'n against the de facfo complainant and others was regI'Stered as a case in Crime No.270 of 2024 of Amaravati police station for the offences u/see.118(1) I/w 190 of the BNS and, as a counter blast to the said case, the present case has been regI®Stered against the petitioners herel'n. It is further submitted by the learned counsel for the petitioners that some of the accused i.e. A1, A3, A7 to A9 and A13 were arrested on 13.ll.2024 and this court granted regular bail to them and they were released. The case of these petI'tiOnerS also Stands On the same footl-ng and prays to grant antl-cipatory bail. 6. Even going by the accusations contained in the FIR, an altercation took place between both the parties on the alleged date of incl'dent and the accused are alleged to have beat the c/e facfo E=- `_ cat
complainant and others. They received simple injuries and were dI'SCharged On the Sal'me day. Learned Assistant Public Prosecutor submitted that major portion of investigation has been completed. In vl'ew of the aforesaid circumstances, this court l's inclined to grant the prayer of the petitioners for grant of anticipatory bail. 7.
Accordingly, in the event of thel'r arrest with regard to this crl'me, petitioners/A2, A4, A5, A6, A12, A17 and A20 shall be released on bail on their executI'ng a Personal bond for a Sum Of Rs.10,000/-(Rupees ten thousand only) each with two suretl'es for the ll'ke sum each to the satI'SfaCtiOn Of the arresting police officl'als and also on condI'tiOn that the petI'tiOnerS Shall make themselves available for investigation as and when required and that they sha" not cause any threat, inducement or proml-se to the prosecutl®on witnesses. The petitioners shall appear before the station House Officer concerned, once in a week l'.e. on every sunday between 10.00 a.m. and 05.00 p.m., tl-Il filing of the charge-sheet. 8.
