1. The instruction forwarded by the hospital to its advocate is taken on record.
2. The Discharge Hand Over Form of the hospital in respect of the petitioner’s wife, since deceased, is produced in Court. A copy of the same has been handed over to the petitioner in Court today.
3. As regards supplying the CD in respect of the surgeries performed on the patient, it has been submitted that no consent was given by the patient party for recording the surgeries. In the absence of consent, the surgeries could not be recorded. There are no CDs available in respect of the surgeries in question.
4. In view of the above, the prayer of the petitioner for handing over of the CDs recording the surgeries of the patient cannot be allowed.
5. The writ petition fails and is hereby dismissed.
6. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all the requisite formalities.
