Ajay Mohan Goel, Judge (Oral) By way of this petition, the petitioner has, inter alia, prayed for the following relief:- “It is, therefore, most respectfully prayed that taking into consideration the aforesaid facts, circumstances and submissions, the present petition may kindly be allowed throughout with costs and the impugned order dated 7.12.2019, passed by the learned Civil Judge, Dalhousie, District Chamba, H.P., in Civil Suit No.5/2011 may be set aside, consequently allowing the application moved by the petitioner under Order 1, Rule 10, read with Order 6 Rule 17, and Section 151 of the Code of Civil Procedure.” 2. The petitioner is aggrieved by the order, in terms 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2025:HHC:37893 whereof, the application filed by the petitioner under Order 6, Rule 17 of the Civil Procedure Code for amending the plaint alongwith an application filed under Order 1, Rule 10 of the Civil Procedure Code for impleading the subsequent purchaser as a party stands rejected by the learned Court below. 3. Having heard learned Counsel for the parties and having perused the order under challenge, this Court is of the considered view that in light of the fact that these transactions had taken place during the pendency of the Civil Suit, but obvious, the same will abide by the principles of lis pendens and therefore, the rejection of the applications filed by the petitioner do not prejudice the case of the petitioner. Learned Counsel for the petitioner submits that this be observed by the Court that whatever was transpired during the pendency of the Civil Suit shall abide by the final outcome of the case. Observed accordingly. 4. With these observations, the petition stands disposed of. Interim order, if any, stands vacated.
