The petitI'On coming On for hearing, upon Perusing the Petition and the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri RAJA REDDY KONETI, Advocate for the Petitioner and of PUBLIC PROSECUTOR for Respondent, the Court made the following ORDER THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 9776/2024 ORDER: The Criminal Petition, u/Sec.482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the petitioner/A2 to grant anticipatory bail in connection with Crime No.25/2024 of C.I.D. Police Station, Mangalagiri. 2) A case has been registered against the petitioner and others for the offences punishable under Sections 420, 4O9, 468, 471 read with 120B IPC and Section 13(2) of the P.C.Act,1988. 3) Case of the prosecution in brief is that: The branch head of Union Bank of India, Brodipet branch, Guntur , gave a report alleging that five persons who are Al to A5 worked in the branch. As per the said report, the regular auditor of the branch found irregularities in sanction and disbursement self help group (SHGCC) and related saving accounts of the groups. The bank conducted investigation and found siphoning of funds by transferring the amounts to saving account of different individuals, material alterations enhancing the limits without following SHG guidelines, crediting the loan amount to group saving account instead of individual saving accounts, keeping part of the loan amount in Saving account for future adJ-uStment etC. The enquiries made by the l'nvestl'gatl-ng officer revealed that irregularities were deliberately committed when the transactions were placed before the fraud monitorI-ng group, the transactions/incl-dents were classI-fI'ed as fraud. lt was also found that serious irregularl'tI-eS Were observed in crediting of pasupu Kumkuma (scheme by ,Government) cheques I-n savl-ng accounts of 43 self help groups. The irregularitI-eS found were that the amount received was directly credited to I'nd,'Vidual accounts wI-thOut any authentl'catl'on for the corrections made on the cheques. Instead of crediting the amounts to SHG group accounts and there from to the jndivjdual accounts, the amounts were credited to I-ndivl'dual accounts dl®rectly. 4) Heard. perusedtherecord. 5) A perusal of the material available on record goes to show that they were not due diligent in discharging thel'r duty. Except the said accusatI-On, there is no other accusation i.e. as against the petI-tI'Oner herein. Apart that the petitioner is a lady aged about 40 years. ln view of the aforesalld cl'rcumstances, this court js I-nclI'ned to grant the prayer of the petitioner/A2 for grant of anticI-PatOry bail. 6) Accordingly, Ion the event of her arrest with regard to this crI®me, petI'tI-Oner/A2 shall be released on bail on her executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only), wl-th two sureties for the dr Esp psk like sum to the satl|sfaction of the arrestI'ng Police offic,'a's and also on condition that the petitioner shall make herself available for investjgat,Ion as and when requI®red and that she shall not cause any threat, I-nducement or Promise tO the prosecution witnesses.
