PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A1, A3, A7 to A9 and A13, seeking regular bail, in Crime No.269 of 2024 of Amaravati Police Station, Palnadu district. 2 2. A case has been registered against the petitioners herein and others for the offences punishable under Sections 351(2), 118(1), 109(1), 189(2), 189(4) and 190 of the Bharatiya Nyaya Sanhita, 2023 (for short „BNS‟). 3. Case of the prosecution, in brief, is that, on 12.11.2024, at about 7.30 pm, when the de facto complainant along with three others namely Tirumallasetty Sambasiva, Perumalla Ramaiah and Rajyaiah stood at Ranga Statue, all the accused attacked and beat them indiscriminately uttering words as “Champandi”, as a result, the de facto complainant sustained bleeding injury over the nose and swelling injury on either sides. The above said three persons also sustained bleeding injuries. When the relatives of the de facto complainant raised cries, all the accused fled away by threatening to do away their lives. 4. Heard. Perused the record. 5. It is submitted by the learned counsel for the petitioners that there is a dispute between the de facto complainant‟s party and the accused party and case and counter cases were registered against each other. He further submitted that the complaint given by the petitioners herein against the de facto complainant and others was registered as a case in Crime 3 No.270 of 2024 of Amaravati Police Station, under Section 118(1) read with 190 of the BNS and, as a counter blast to the said case, the present case has been registered against the petitioners herein. 6. Even going by the accusations contained in the FIR, an altercation took place between both the parties on the alleged date of incident and the accused are alleged to have beat the de facto complainant and others. They received simple injuries and discharged on the same day. Petitioners were arrested on 13.11.2024 and since then they are in judicial custody. Learned Assistant Public Prosecutor submitted that major portion of investigation has been completed. 7. In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioners/A1, A3, A7 to A9 and A13, on the following conditions. i) The petitioners/A1, A3, A7 to A9 and A13 shall be released on bail on their executing personal bonds for Rs.10,000/- (Rupees Ten Thousand only) each with two sureties of the like sum each to the satisfaction of the learned II Additional Junior Civil Judge, Sattenapalli. 4 ii) On release, the petitioners shall appear before the Station House Officer concerned, once in a week i.e., on every Saturday between 10.00 am and 01.00 pm, till filing of the charge sheet. 8.
