1. The present Civil Miscellaneous Petition has been filed by the petitioner for recalling of the order dated 27.09.2019 and restoration of W.P(C) No. 6097 of 2018, which was disposed of vide order dated 27.09.2019 passed by this Court on the basis of a compromise entered into between the respondent no. 2 (Developer) and the respondent no.3 (Land Owner) herein, without adjudicating upon the issues raised by the petitioner.
2. After some argument, Mr. Nitin Kumar Pasari, the learned counsel appearing for the petitioner seeks leave of this Court to withdraw the present Civil Miscellaneous Petition with liberty to search out the remedy for redressal of grievance.

3. Such submission has been made in presence of the learned counsel appearing for the respondent-RMC who has raised no objection.
4. Leave, as prayed for, is granted.
5. Accordingly, the present Civil Miscellaneous Petition is dismissed as withdrawn with the liberty aforesaid.
6. Pending I.As, if any, stands disposed of.
