ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A3, seeking bail, in Crime No.311/2023 of Parawada Police Station, Anakapalle District.
2. A case has been registered agal-nst the petitioner and others for the offences under Sections 20(b)(ii)(B) read wl'th 8(c) of the Narcotic Drugs and Psychotropic Substances Act.
3. The case of the prosecution is that: On 07.9.2023 at about 10.00 am, on receipt of credible information regarding illegal possession and transportation of ganja, s.I of Police, Parawada Police Station, along with staff reached simhadri junction, JNPC, Parawada Mandal and found Al and A2 in suspicious circumstances. On enquiry, they dl-sclosed their identity particulars and POliCe Seized 4kgs of ganja from thel'r possession and they confessed that they purchased ganja from A3 at Narsipatnam. Al and A2 were arrested. Al was arrested on 06.12.2024 and got remanded to judicial .custody.

Learned Assistant publI-C Prosecutor submits that major part of the investl'gation I-s completed and charge sheet is yet to be filed. 6, A perusal of the material available on record goes to showthat the Petitioner/A3 was arrested and remanded to judicI'al custody on 06,12.2024. Basing on the confessional statement of co-accused, the Petitioner has been shown as an accused in the present crime. The accusation is against the co-accused only. Except the confessional statement, there is no other material to connect the petitI-Oner With the Crlme. Purs nt to the confessional statement of co-accused, no eized from aforesaid the petitl-oner.
