2 2 The present petition has been filed by the petitioner with the following prayer:-
“It is, therefore, humbly prayed that, the Hon’ble Court may kindly allow the petition and quash the FIR in Crime No.476/2020 registered in Police Station City Kotwali, District Raigarh as well as the entire charge sheet along with subsequent proceeding pending in relation to FIR No.476/2020 registered in Police Station City Kotwali, District Raigarh.” 3
Learned counsel for the petitioner submits that the trial is in progress and the evidence of prosecution witnesses has already been recorded. 4 Learned State counsel endorses the said submission of learned counsel for the petitioner. 5 Considering the facts and circumstances of the case, particularly the fact that the trial is going on and there is no material available on record to show that any prima facie case is made out for quashing of the FIR, charge sheet along with subsequent proceedings.
