The petitioners are apprehending their arrest in connection with Complaint Case PS Case No.231 of 2021, for offence registered under section 33(1)(c) of the Indian Forest Act, 1927, pending in court of learned Additional Chief Judicial Magistrate, Chatra.

Learned counsel for petitioners submits that false allegations are made of cultivation of poppy plant in the forest area and he submits that even the land is not belonging to the petitioners and the petitioners have got no criminal antecedent as disclosed in paragraph no.20 of the petition.
4. Learned State counsel opposes prayer and submits that illegally poppy plant has been cultivated in the land of the forest department.
5. Considering that allegation is made of cultivation of poppy plant in the forest land and even the land is not belonging to the petitioners and the petitioners have got no criminal antecedents as aforesaid, I am inclined to grant anticipatory bail to petitioners.

Accordingly, petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Additional Chief Judicial Magistrate, Chatra, in connection with Complaint Case PS Case No.231 of 2021, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
