Projected grievance of the petitioner is in relation to his junior Sh. Desh Raj (not party to the writ petition) drawing higher pay than him, hence, this writ petition was instituted for the grant of following substantive reliefs: - “(i) That the impugned order dated 03.12.2020 contained in Annexure P-6 passed by the Managing Director of respondent- Federation may kindly be quashed and set-aside being malafide, discriminatory, arbitrary, illegal and violative of Articles 14 and 16 of the Constitution of India, by issuing writ of Certiorari. (ii) That a writ in the nature of mandamus may kindly be issued, directing the respondents to re-fix the pay of the petitioner 1 Whether reporters of the local papers may be allowed to see the judgment? yes 2 taking into consideration the pay fixation order dated 14.09.2006 (Annexure P-4) relating to the person junior to the petitioner, Sh. Desh Raj. M.P.A. (Retired) and release the entire arrear amount alongwith interest @ 9% per annum and accordingly, revise the DCRG amount, Leave encashment and EPF pension be also get revised by submitting Form 3-A (Revised) to the EPFO, SDA Complex, Block No. 34, Kasumpti, Shimla-9 and justice be done.” 3. When the matter was taken up for hearing, learned vice counsel for the respondent placed on record certain office documents and, on that basis, submitted that the pay of Sh. Desh Raj had been wrongly fixed; however, pursuant to the orders passed by the respondent on 03.12.2020, pay of Sh. Desh Raj has been re-fixed under office order dated 03.12.2020. 4. Learned counsel for the petitioner acknowledges the position that the petitioner as well as Sh. Desh Raj are now drawing the same pay-scale. Learned counsel submits that petitioner’s grievance raised in this writ petition has now been redressed. 5. In view of above, the present petition to stand disposed of as the grievance of the petitioner raised in this writ petition now stands redressed.
