The petitioner is apprehending his arrest in connection with Garhwa P.S. Case No. 371/2022, registered for the offences under sections 419, 304, 384, 385, 420, 201, 120(B) of Indian Penal Code, pending in the Court of learned Chief Judicial Magistrate, Garhwa. 3. Learned counsel appearing for the petitioner submits that the allegations are made that one hospital namely Maa Garhdevi Hospital was being run in absence of any license. He further submits that the allegations are made that certain person used to recommend some persons to go to that hospital. He then submits that the only allegation against the petitioner is that she recommended some person to go to that hospital apart from that there is no other allegation. He next submits that the petitioner has got no criminal antecedent as disclosed in Para -7 of the petition. 4. Learned counsel for the State opposed the prayer and submits that the allegations are there against the petitioner of recommending some persons to go to that hospital. 2025:JHHC:35899 2 5. Considering that the only allegations against the petitioner is that he has recommended some persons to go to that hospital and the petitioner has got no criminal antecedent; I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner above named is directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of his surrender / arrest, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned Chief Judicial Magistrate, Garhwa, in connection with Garhwa P.S. Case No. 371/2022, subject to the condition as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. 7.
