JUSTICE ANIL KUMAR SINHA ORAL ORDER 2 06-05-2025 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. 2. This application, for grant of anticipatory bail, arises out of Madhepura P.S. Case No. 871 of 2023, disclosing offences under Sections 341, 323, 307, 364(B), 379, 427, 436, Patna High Court CR. MISC. No. 27057 of 2025(2) dt.06-05-2025 2/3 504 and 34 of the I.P.C. 3. As per the F.I.R., on 19.08.2023, in the morning petitioners along with other accused persons armed with lathi, rod, khanti, dabia, spade etc. arrived at the informant’s house and forcibly demolished the same. Subsequently, Manoj Ram, Subodh Ram, Ganesh Ram, Ajesh Ram (petitioner no. 7) set the house on fire by sprinkling petrol. It has further been alleged that the other accused persons assaulted the family members of the informant. 4. Learned Counsel for the petitioners submits that both the parties are co-villagers and closed door neighbours and there was previous dispute between them. The allegation of assault upon the informant and family members along with others is upon petitioner no. 6, 7 and 8, but injury is simple in nature as is evident from Annexure- P/2 series. 5. Having regard to the submissions made by the parties and taking into consideration the fact that there is specific allegation against petitioner no. 7, namely, Ajesh Ram that he set the house of the informant on fire, I am not inclined to grant the privilege of anticipatory bail to the petitioner no. 7, namely, Ajesh Ram. His prayer for bail is rejected. 6. In so far as other petitioners nos. 1 to 6 and 8, are Patna High Court CR. MISC. No. 27057 of 2025(2) dt.06-05-2025 3/3 concerned, considedring the fact that the parties are neighbours and had previous dispute and injuries sustained by the informant and his family members are simple in nature, I am inclined to grant the privilege of anticipatory bail to petitioner nos. 1 to 6 and 8. 7. Let the petitioner nos. 1 to 6 and 8, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura, in connection with Madhepura P.S. Case No. 871 of 2023, subject to the condition laid down under Section 482 (2) of the B.N.S.S. aditya/- (Anil Kumar Sinha, J) U T
