The petitioners are apprehending their arrest in connection with Chhattarpur P.S. Case No.233/2024, registered for the offence under Sections 80(2)/3(5) of the BNS, pending in the Court of the learned Judicial Magistrate, 1st Class, Palamau. 3. Learned counsel appearing for the petitioners submits that petitioner nos. 1 and 2 are brother-in-law, petitioner no.3 is mother-in-law and petitioner nos. 4 and 5 are sister-in-law of the deceased. He further submits that the petitioners have been falsely implicated in the case, whereas, the deceased has committed suicide. He also submits that the independent witnesses including the maternal uncle of the deceased have not supported the case. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there against the petitioners and the ( 2025:JHHC:30332 ) -2- A.B.A. No. 5747 of 2025 deceased has committed suicide pursuant to their instigation. 5. Considering that the petitioner nos. 1 and 2 are brother-in-law, petitioner no.3 is mother-in-law and petitioner nos. 4 and 5 are sister-in-law and what is the nature of instigation for taking such step by the deceased, so far as these petitioners are concerned, is not clear and in the attending facts and circumstance of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners. 6. Accordingly, the above-named petitioners are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Palamau in connection with Chhattarpur P.S. Case No.233/2024, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Dated: 26th September, 2025 Ajay/
