Jail, Pali) ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Narendra Singh A Rajpurohit For Respondent(s) : Mr. Prem Singh Panwar, PP HON'BLE MR. JUSTICE KULDEEP MATHUR Order 09/01/2025 1. These applications for bail under Section 483 BNSS have been filed by the petitioners who have been arrested in connection [2025:RJ-JD:1438] (2 of 3) [CRLMB-16102/2024] with F.I.R. No.202/2024 registered at Police Station Jetpur, District Pali for offences under Sections 115(2), 126(2), 110, 189(2) & 117(2) of BNS. 2. Heard learned counsel for the petitioners and learned Public Prosecutor. Perused the material available on record. 3. Learned counsel for the petitioners submitted that the petitioners have been falsely implicated in the present case. 4. Drawing attention of the Court towards the injury report of the injured Hanumanram, learned counsel for the petitioners submitted that in the alleged incident which occurred on 27.11.2024, injuries allegedly inflicted by the petitioners upon injured persons are though grievous in nature but the same are not dangerous to life and not on any vital body parts. Learned counsel for the petitioners submitted that the investigation in the matter against the present petitioners has already been completed and challan has already been filed before the competent Criminal Court. 5. Lastly, learned counsel for the petitioners submitted that the petitioners are in judicial custody and the trial of the case will take sufficiently long time to conclude, therefore, the benefit of bail may be granted to the accused-petitioners. 6. Per contra, learned Public Prosecutor has vehemently opposed the bail application. However, he was not in a position to refute the fact that the injuries allegedly inflicted by the petitioners upon injured persons are though grievous in nature but the same are not dangerous to life. [2025:RJ-JD:1438] (3 of 3) [CRLMB-16102/2024] 7. Having considered the rival submissions, facts and circumstances of the case, this court has also prima facie finds that the petitioners are in judicial custody, the investigation against them has already been completed. This court also prima facie finds that the prosecution has not shown any apprehension of petitioners influencing the material prosecution witnesses of the case or fleeing away from justice, in case they are enlarged on bail, thus without expressing any opinion on merits/demerits of the case, this Court is inclined to enlarge the petitioners on bail. 7. Consequently, the bail applications under Section 483 BNSS are allowed. It is ordered that the accused-petitioners Chena Ram S/o Gevar Ram, Dola Ram S/o Bhera Ram, Dhanna Ram S/o Kanna Ram, Kisna Ram S/o Ghevra Ram and Kana Ram S/o Soma Ram arrested in connection with F.I.R. No.202/2024 registered at Police Station Jetpur, District Pali shall be released on bail, if not wanted in any other case, provided each of them furnishes a personal bond of Rs.50,000/- and two sureties of Rs.25,000/- each, to the satisfaction of learned trial court, for their appearance before that court on each & every date of hearing and whenever called upon to do so till completion of the trial.
