[2025:RJ-JD:479] (2 of 3) [CRLMB-15794/2024] 06/01/2025 These applications for bail under Section 439 Cr.P.C. (483 BNSS) have been filed by the petitioners who have been arrested in connection with F.I.R. No.634/2024, registered at Police Station Sukher, District Udaipur, for offences under Sections 126(2), 115(2), 189(2), 324(4), 324(6), 329(4), 331(6) and 331(8) of BNS. Heard learned counsel for the parties at Bar. Perused the material available on record. Having considered the rival submissions, facts and circumstances of the case and after perusing the case diary, this Court prima facie finds that in the alleged incident which occurred on 02.12.2024, the injuries allegedly inflicted by the petitioners upon the injured persons are simple in nature. This Court further prima facie finds that the petitioners does not have any criminal antecedents; the blunt weapons allegedly used by the petitioners in commission of the alleged crime have already been recovered by the Investigating Agency; the petitioners are in judicial custody; and the trial of the case is not likely to be concluded in the near future. Thus, without expressing any opinion on merits/demerits of the case, this Court is inclined to enlarge the petitioners on bail.
Consequently, these bail applications under Section 439 Cr.P.C. (483 BNSS) are allowed. It is ordered that the accused- petitioners- 1. Surendra S/o Shri Badan Singh, 2. Ashik S/o Vanraj, 3. Amit Bhai S/o Shri Prabhu Das, 4. Manoj Kumar S/o Shri Chaman Bhai, and 6. Swarup S/o Nen Ram, arrested
