Case No. 40/2022 corresponding to G.R. Case No. 32/2023, for the offences registered under Sections 452, 341, 323, 307, 364, 302/34 of the I.P.C. and Section 3 / 4 of the Prevention of Witch Craft Practices Act, pending in the Court of learned Additional Sessions Judge-I, Simdega. On 24.10.2022, at about 01:00 A.M., the petitioner alongwith two other named accused persons came to the house of the informant. They caught hold of him and his wife and dragged them outside and started assaulting them by rod and knife. The wife of the petitioner succumbed to her injuries. Learned lawyer for the petitioner submitted that nine witnesses have been examined in this case. Learned A.P.P submitted that the bail application of similarly situated co-accused has been rejected earlier by this court vide B.A. No. 534/2025. Regard being had to the facts and circumstance of the case and considering the nature of allegation and the fact that trial of this case is under progress; I am not inclined to enlarge the petitioner on bail.
