(Lodged In Sub Jail Nohar) ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. J.K. Suthar For Respondent(s) : Mr. Narendra Gehlot, PP with Mr. Omprakash Choudhary HON'BLE MR. JUSTICE MANOJ KUMAR GARG Order 09/01/2025 The petitioner has been arrested in connection with FIR No.539/2022 of Police Station Nohar, District Hanumangarh for the offences punishable under Sections 8/21, 25 & 29 of NDPS Act. He has preferred this bail application under Section 483 BNSS. Counsel for the petitioner submits that earlier the bail was granted to the petitioner but he jumped the bail for total period of six months and now the petitioner is behind the bars since 13.12.2024. He further submits that one more opportunity should be given to the petitioner and assures to this Court that in future, the petitioner will remain present on each and every date before the trial court and if he again jumps the bail then the indulgence of bail may not be extended to the petitioner. Learned Public Prosecutor has opposed the bail application. [2025:RJ-JD:1389] (2 of 2) [CRLMB-16027/2024] Heard learned counsel for the petitioner as well as learned Public Prosecutor and also perused the material on record. Looking to the facts and circumstances of the case, I deem it just and proper to grant one more opportunity to the petitioner subject to the condition that he will appear before the learned trial Court on each and every date as fixed by the trial Court, failing which Public Prosecutor may file an application for cancellation of bail. Accordingly, the bail application filed under Sec.483 BNSS is allowed and it is directed that petitioner Sarbar @ Dholiya S/o Akbar Khan, shall be released on bail in connection with FIR No.539/2022 of Police Station Nohar, District Hanumangarh provided he executes a personal bond in a sum of Rs.2,00,000/- with two sound and solvent sureties of Rs.1,00,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
