Accused Nos. 1 and 4 in crime No. 332/2024 registered by Ramamurthynagar Police Station, Bengaluru, for offence punishable under Sections 304B, 306, 201, 498A read with Section 34 of IPC are before this Court under Section 438 of Cr.P.C. seeking anticipatory bail. 2. Heard learned counsel for the parties. 3. FIR in crime No. 332/2024 was registered by the Ramamurthynagar Police Station, Bengaluru for the - 3 - NC: 2025:KHC:15421 CRL.P No. 14140 of 2024 aforesaid offences against Roshith and others based on the first information dated 12.06.2024 received from Smt. Geetha K.B. who is the mother of the deceased Shruti. Apprehending their arrest in the said case, petitioners herein who are arraigned as accused Nos. 1 and 4 in the FIR had filed Crl.Misc. No. 7887/2024 before the jurisdictional Sessions Court which came to be rejected on 25.10.2024. Therefore, they are before this Court. 4. A perusal of the material on record would go to show that the marriage of petitioner No. 1 with the deceased Shruti was solemnized on 30.04.2023. Shruti had committed suicide in her house on the intervening night of 28.05.2024 and 29.05.2024 by hanging herself. First information is belatedly submitted on 12.06.2024 against the husband of the deceased and his relatives. A perusal of the averments found in the FIR would prima facie reveal that though allegation is made against accused about ill treating the deceased in her matrimonial house, there is no serious allegation of demand by the - 4 - NC: 2025:KHC:15421 CRL.P No. 14140 of 2024 accused for payment of dowry. Petitioners herein are engineers by profession and they do not have criminal antecedents. They have undertaken to cooperate with the Police for the purpose of the investigation. Under the circumstances, petitioners request for grant of anticipatory bail requires to be answered in the affirmative. 5. The petition is allowed. The respondent - Police or any other Police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No. 332/2024 registered by Ramamurthynagar Police station for the offences punishable under Sections 304B, 306, 201, 498A read with Section 34 of IPC , subject to the following conditions: 1. The Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum to the satisfaction of the Investigating Officer. - 5 - NC: 2025:KHC:15421 CRL.P No. 14140 of 2024 2. Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3.
