JUDGMENT : Ajay Mohan Goel, J. By way of this petition, the petitioners have assailed order dated 17.05.2025, passed by learned Civil Judge, Ghumarwin, District Bilaspur, H.P., in CMA No. 255/2025, in Civil Suit No. 759-1 of 2024, in terms whereof, application filed by the petitioners for grant of police assistance, was dismissed. 2. Having heard learned counsel for the petitioners as also learned Senior Counsel for the respondents and taking into consideration the order under challenge, this Court is of the considered view that there is no infirmity therein. 3. Of course, there is an order passed by the learned Trial Court in favour of the petitioners and in case as per the petitioners, the same is being infringed or violated by the respondents then the petitioners can have appropriate recourse thereto, as has been suggested by the learned Trial Court also. The contention of the learned counsel for the petitioner that the police assistance be given to restore water connectivity, cannot be ordered by the Court for the reason that the same shall amount to this Court ratifying the allegations of the petitioners that indeed there is a violation of the order passed by the learned Trial Court by the respondents herein. 4. This has to be proved by the petitioners before the appropriate Court and if the circumstances so demands, then appropriate directions can be passed by the Court including that of police assistance, but not in the mode and manner in which it is being sought by the petitioners. 5. In light of above observations, this petition is dismissed. Pending miscellaneous application(s), if any, also stand disposed of accordingly.
