PUBLIC PROSECUTOR The Court made the following: THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 125/2025 ORDER: The instant criminal petition under Section 482 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C) has been filed by the Petitioners/Accused Nos.3 to 5, seeking for quashment of the proceedings pending against them in Cr.No.121 of 2022, before the Veldurthy Police Station, Palnadu District, registered for the offences punishable under Sections 8(c), 20(b) of the NDPS Act. 2. Heard Sri Challa Srinivasa Reddy, learned counsel for the petitioners and Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor for the State. 3. Learned counsel for the petitioners would submit that except the confession statement of the Accused No.1, there is nothing against the petitioner herein, who are the Accused Nos.3 to 5 against who the case in Cr.No.121 of 2022, before the Veldurthy Police Station, Palnadu District, was lodged for the offences punishable under Sections 8(c), 20(b) of the NDPS Act. Learned counsel would further submit that nothing is recovered from the possession of the petitioners/Accused Nos.3 to 5 and the contraband alleged to have been seized from the possession of the Accused No.1in this crime is about 3Kgs and continuing the criminal proceedings against the petitioners herein is mere abuse of process of law. 4. Learned Assistant Public Prosecutor appearing for the State had vehemently opposed the petition and would submit that it is at the crime stage at which threshold the present petition is filed and further the investigation is not yet completed in this matte and the Charge sheet is also not filed by the Police and that the petition may be disposed of by giving liberty to the Police to proceed further in the matter to unearth the truth 5. Considering the submissions made, the Criminal Petition is disposed of without causing any prejudice to the rights and contentions of the petitioners. However, the Police are directed to complete the investigation and file a report in accordance with law as expeditiously as possible.
