1. This is an ofÏce reference.
2. This Court, vide order dated 14.02.2024, passed in MCRC No. 8594 of 2023, while allowing the bail to the applicants, namely, Rakesh Dharuwa and Gobinda Ghibila, had expressed its trust that the trial Court should make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the date of receipt of a certified copy of this order, if there was no legal KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 impediment.
3. Earlier on one occasion also this Court had granted extension of time for complicance of the order dated 14.02.2024.
4. The learned Special Judge (NDPS Act), Saraipali, District- Mahasamund, (C.G.) vide his request letter dated 16.12.2024 has requested for grant of some more time for concluding the trial.
5. It transpires from perusal of the PUD, that in this case, after the charge sheet was presented on 30-12-2023, the statements of 4 witnesses were recorded till 08-07-2024. Thereafter, due to the continuous absence of both the accused, their bail bonds were cancelled and arrest warrants were issued against them on 15-07-2024. Since then, arrest warrants have been continuously issued against them on several dates, but the accused have not been presented to date, due to which, it is likely to take some time for concluding the trial. Therefore, she prays for grant of further more time for concluding the trial.
6. The request appears to be reasonable. The concerned trial Court is
directed to conclude the trial as early as possible, preferably within a further period of four months from today.
7. Accordingly, this CRMP stands disposed off with the aforesaid direction.
8. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
