Neutral Citation No. - 2025:AHC:53328 Court No. - 80 Case :- APPLICATION U/S 529 BNSS No. - 702 of 2025 Applicant :- Kiran Yadav Opposite Party :- State Of U.P. And 6 Others Counsel for Applicant :- Abhisht Jaiswal,Mayank Chandra,Surya Pratap Singh Counsel for Opposite Party :- G.A. Hon'ble Nalin Kumar Srivastava,J.
1. This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to decide the Case No.2404 of 2023 (Kiran Vs. Amarjeet Yadav and others) under Sections 498-A, 323, 504, 506 IPC and Section 3/4 Dowry Prohibition Act, Police Station Cantt., District Varanasi pending in the Court of Addl. Civil Judge (S.D.) 4th, Varanasi, expeditiously within a stipulated period.
2. Heard learned counsel for the applicant as well as learned A.G.A. for the State.
3. It is submitted by the learned counsel for the applicant that it is a complaint case and the applicant is the complainant / aggrieved wife in this case, which is pending since 2023. Statement of the complainant and witnesses have been recorded under section 200 and 202 Cr.P.C. but however no summoning order has been passed till date. About two years have been passed since the initiation of the present proceedings, yet no significant progress has been made in this case.
4. I have considered the submissions and perused the entire record.
5. It is very strange that despite the pendency of the present case since 2023, no summoning order has been passed so far. The copies of the order-sheet have been annexed. Trial court is directed to pass the order on the point of summoning of the accused, without granting any unnecessary adjournment to the complainant side, within a period of two months from the date of receiving of certified copy of this
order.
6. With the above observations, the application stands disposed of.
