1. Heard the parties. 2. The petitioner apprehends his arrest in connection with Sasaram Town P.S. Case No. 208 of 2025 dated 13.03.2025 registered under Section 30(a) of the Bihar Prohibition & Excise Act, 2022 (Amended). 3. As per the first information report the police party recovered a total quantity of 409.125 liters of foreign liquor from the ‘dala’ of Mahindra 275DI tractor bearing chasis no. MBNABAEXPLRC09000, Engine No. RLC2EAN0798 and it is alleged that the seized liquor belonged to one Akhilesh Kumar which was being transported in tractor by the petitioner. 4. Learned counsel for the petitioner submits that petitioner
Patna High Court CR. MISC. No.24966 of 2025(2) dt.06-05-2025 2/3 has falsely been implicated in the present case and he has not committed any offence in the manner alleged. The petitioner is neither the owner nor the driver of the said tractor. The name of the petitioner transpired in this case only on the basis of suspicion. Illicit liquor has not been recovered from the conscious possession and / or from the vehicle belonging to the petitioner. Police during search and seizure did not follow the provisions contained under Section 100 Cr.P.C. The petitioner has clean antecedent. 5. Regard being had to the submission made by the parties, taking into consideration the nature of allegation, the fact that petitioner is neither the owner nor driver of the said tractor and he is having clean antecedent accordingly I am inclined to grant anticipatory bail to the petitioner. 6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs.
10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 2 cum District & Additional Sessions Judge, Rohtas at Sasaram in connection with Sasaram Town P.S. Case No. 208 of 2025 subject to the
