The Court made the following:
ORAL ORDER:
Heard Sri Naga Praveen Vankayalapati, learned Counsel for the Petitioners and Sri Arjun Chowdary, learned Assistant Government Pleader for Revenue.
2. Learned Counsel for the Petitioner has drawn the attention of this Court to the impugned Notice issued to the Writ Petitioner under Section 6 of the Madras Encroachment Act (Act 3 of 1905). Learned Counsel for the Petitioner submits that the Petitioner has also received a Notice issued under Section 7 of the Madras Encroachment Act (Act 3 of 1905). It is also stated that the Notice issued under Section 7 did not contain the name of the Petitioner.
3. On the face of it, it is noticed by this Court that both the notices namely the Notice issued under Section 7 and Notice issued under Section 6 are under Madras Encroachment Act (Act 3 of 1905). There is no such Act existing in the State of Andhra Pradesh. Accordingly, both the Notices (Ex.P1) are set aside. However, Respondents are given liberty to proceed in accordance with law, if they so choose.
4. With these observations and directions, this Writ Petition stands allowed. No order as to costs.
5. Interlocutory Applications, if any, stand closed in terms of this order.
