PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A2, seeking regul.ar bail, in Crime No.76 of 2024 of Gandepalli Police Station, Kakinada district. 2| A case has been registered against the Petitioner herein and others for the offence punishable under Section 8(c) read Q=-I a,fJ,P-yd,
2 r7 wl'th 20(b)(ii)(C) of the Narcotic Drugs and psychotropic Substances Act, 1985 (for short 'the NDPS Act'). 3. Caseofthe prosecution, l'n brief, is that, on 19.02.2024, at about 06.00 PM, on receipt of credible I'nfOrmatiOn, the Sub- Inspector of Police, Gandepalli police Station, along with his staff and mediators, conducted raid at canal bund, situated at the outskirts of Murari village, GandepaIIi MandaI, Kakinada district and found Al to A3 in possession of 250.620 Kgs of Ganja. On seeing the police party, Al and A2 escaped from the spot.
A3 was arrested and contraband was seized under cover of a mediators report and a case has been registered against the accused. 4. Heard. Perused the record. 5. A perusal of the material on record goes to show that basing on the confessional statement of co-accused, the name of the petitioner herein was shown as accused in the present case. Pursuant to the said confessional statement, the police arrested the petitioner herein/A2 on 12.09.2024 and since then he is in judicial remand. Nothing has been seized from the possession Of the Petitioner herein and the alleged contraband Was Seized from the possession OfA3. Learned AssI'Stant Public sz2Z,)
prosecuto.r submitted that major portion of investigation has been completed. He further submitted that the Petitioner herein is also involved in another Crime. 6. ln view of the aforesaid facts and Circumstances Of the case and, since major portion of investigation has been completed, this court is inclined to grant bail tO the Petitioner/A2 on the following conditions. i) The petitioner/A2 shall be released On bail On his executing a personal bond for Rs.10,000/- (Rupees Ten Thousand only) with two Sureties Of the like Sum each tO the satisfaction of the learned I Additional District and Sessions Judge-Gum-Special Judge for trial of offences under the NDPS Act, Rajamahendravaram, East Godavar-I district. ii) on release, the petitioner shall appear before the station House Offilcer concerned, every day between 10.00 am and o1,00 pm, till filing of the charge sheet. 7.
