03/ 12.12.2025 This civil miscellaneous petition has been filed for restoration of C.M.P. No. 927 of 2023 to its original file, which was dismissed due to non-compliance of peremptory order dated 02.01.2025 passed by this court.

Learned counsel appearing for the petitioner submits that the civil miscellaneous petition was defective and inadvertently within time, the defects have not been removed, in view of that the said petition was dismissed.

In view of the above and considering that at the defective stage itself, the CMP was dismissed and even notice has not been issued to the opposite parties and further in light of the averments made in the civil miscellaneous petition, sufficient ground is made out to restore of the civil miscellaneous petition. As such, C.M.P. No. 927 of 2023 is restored to its original file.

This civil miscellaneous petition is allowed and disposed of.
