ORAL JUDGMENT (PER: HON'BLE THE CHIEF JUSTICE MR. JUSTICE N. V. ANJARIA)
Heard learned advocate Mr. A.T.Mallya for the petitioner- the complainant and learned Additional Government Advocate Mr. S.H.Raghavendra for respondent nos.1 and 2. 2. The contempt is alleged in respect of breach of the directions contained in the order dated 23.09.2024 passed by learned Single Judge in Writ Petition No.21552 of 2024. The directions required respondent No.2-the Station House Officer, Peenya Police Station, Bengaluru, to conduct inquiry pursuant to the compliant of the petitioner dated 27.06.2024. 3.
While the contention of learned advocate for the complainant is that respondent No.2 has not conducted an inquiry so far, on a reading of the directions, it would become evident that no time limit is prescribed by the court for conducting such an inquiry. In the circumstances, it is not possible to conclude that a contempt of court, much less a willful contempt is committed by respondent No.2 in not concluding the inquiry. - 4 -

At the same time, since there is a direction to conduct the inquiry and the directions of the court should not go uncomplied with, it is provided that respondent No.2 shall conduct the inquiry and complete the same within three weeks from the date of receipt of a copy of this order, failing which respondent No.2 shall be espoused to aggravated form of contempt. 5.
