(Item D-13) State of H.P and others vs. Harish Kumar CMP(M) No.1805 of 2025 11.11.2025 Present: Mr.Pranay Pratap Singh, Additional Advocate General for the applicants. Inter-alia contends that it was the case of the writ petitioner itself that the land had been utilized in the year 1994-95 for the purposes of Kharapathar-Sari road. It is submitted that the stand of the State, as such, was that the construction was done in the year 1985-86, as per demand of the people of the area. It is thus submitted that a direction now to acquire the land, in accordance with law, would entail a huge amount of interest and the land owners cannot be benefited with the same. A reference is made to the pendency of LPA No.337 of 2025 titled State of H.P and another vs. Punit Bashtu along-with connected matters. Keeping in view the averments made in the application duly supported by the affidavit of the official, we are of the opinion that sufficient cause has been made out to condone the delay. Accordingly, delay of 166 days, as confirmed by the office, is condoned. Appeal be registered. Application stands disposed of.
