Order or direction :: particularly one in the nature of Writ Mandamus declaring the action of the respondents in not paying minimum compensation of Rs. 5,00,000/- Rupees Five Lakhs only to the Petitioner herein for the death of her husband Ganne Chaitanya Kumar, S/o Ramanayudu due to ‘Electric Shock’ on 30.04.2023 even after lapse of considerable time as bad, illegal, arbitrary and violation of Articles 14, 21 of the constitution of India and contrary to A.P. Gazette notification No.241, Dated 29.05.2017 and principals of natural justice and consequently to direct the Respondents to pay ex-gratia of Rs.5.00 Lakhs Rupees Five Lakhs only to the Petitioner herein within a time bound period and to pass such other order or orders..." Heard learned counsel for petitioner and learned Standing Counsel for APSPDCL for the respondents.
Learned counsel for the petitioners husband Sri Ganne Chaitanya Kumar years met with a fatal electrical accident (Electrical Shock) was trying to remove wire fell down in front of the petitioner’s house due to heavy rams and died instantaneously. He further submits more of

.# under the provisions of the Electricity Act, 2003 (Central Act No.36 of 2003), the Government of Andhra Pradesh/APERC notified minimum compensation of Rs.5,00,000/- (Rupees Five Lakhs only) to the bereaved family in case of “Fatal-electrical accidents” and issued
“Compensation to the Victims of Electrical Accidents Regulation, 2017” (Regulation No.2 of 2017) vide Gazette No.241, dated
29.05.2017. Pursuant to the said Gazettee notification, the petitioner herein submitted representations dated 05.05.2023 and 13.09.2024 to the respondent authorities seeking for sanction of minimum compensation towards ex-gratia for the accidental/ fatal death of her husband caused due to electrical shock. But, even after receipt of the said representations, the respondents neither considered the same nor passed any orders. Hence, the writ petition. On the other hand, learned Standing Counsel for the respondents furnished written instructions dated 17.10.2024, wherein, it is stated that the petitioner is eligible for ex-gratia for an amount of Rs.5,00,000/- for the fatal death of her husband due to electrical shock. It is further stated that the amount entitled by the petitioner will be paid to the petitioner within a reasonable time. Having regard to the submissions made by the

respondents and in view of the written instructions dated 17.10.2024 submitted by the respondents, this Court is of the considered view that the present writ petition can be disposed of, directing the respondents to pay an amount of Rs.5,00,000/- (Five Lakh Rupees only) to the petitioner towards ex-gratia for the fatal death her husband due to electrical shock weeks from the date of receipt of a copy of this order. With the above direction, the writ petition is disposed of. There shall be no order as to costs. caused to within a period of four (04)
