1. Heard learned senior counsel for the applicant and learned counsel for the State.
2. The applicant who is in custody since 03.11.2022 has renewed his prayer for grant of regular bail in connection with Dumka Muffasil P.S. Case No.03 of 2022 corresponding to N.D.P.S. P.S. Case No.03A of 2022, registered for the offence under Sections 414, 420, 120-B and 34 of the Indian Penal Code and under Sections 8(c) 21(c), 22(b) of the N.D.P.S. Act and under Sections 18(c) 27(b)(ii) of the Drugs and Cosmetics Act. Further, the charges has been framed under Sections 22(c) r/w 29 of the N.D.P.S. Act and under Section 27(b)(ii) of the Drugs and Cosmetics Act. Now, the case is pending in the court of learned Additional Sessions Judge-I-cum-Special Judge (N.D.P.S.), Dumka.
3. It appears that it is the third attempt. Earlier the prayer for bail of the applicant had been rejected by this Court vide order dated 28.02.2023 passed in B.A. No.12203. Further, the prayer for bail of the applicant had been rejected vide order dated 24.11.2023 passed in B.A. No.8445 of 2023 with a direction to expedite the trial and conclude the same within a year from the date of receipt/production of a copy of that order.
4. It has been submitted by the learned counsel for the applicant(s) that complete set of FIR along with its enclosure have been annexed with this bail application and there is no suppression on his/her part.
5. Innocence has been claimed by the learned senior counsel for the applicant and undertaking has been given for participation in the trial. It has

been submitted charge has been framed on 17.07.2023 but till date only three charge-sheeted witnesses have been examined out of eleven charge-sheeted witnesses. On the above basis, prayer for bail has been made.

Learned counsel for the State has opposed the prayer for bail.
7. Considering the period of custody and the stage of the trial, I am inclined to enlarge the applicant on bail. Accordingly, the applicant, named above, is
directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I-cum-Special Judge (N.D.P.S.), Dumka in connection with Dumka Muffasil P.S. Case No.03 of 2022 corresponding to N.D.P.S. P.S. Case No.03A of 2022, subject to condition that one of the bailors will be the pariwikar and the applicant will not leave the district without prior permission of the trial court. Further, the applicant(s) will submit self-attested photocopy/photocopies of his/her/their Aadhaar Card(s) and also submit his/her/their mobile number(s) before the learned court below which he/she/they will always keep active and will not change it during pendency of this case without prior permission of the court.
