Mr. Rajan Kahol & Mr. Vishal Panwar, Additional Advocates General with Mr. Ravi Chauhan, Deputy Advocate General, for the non-applicants/ respondents. By way of instant application filed under Section 152 CPC read with Section 151 CPC, prayer has been made on behalf of the applicant/petitioner for modification of order dated 01.07.2025 passed in CWP No.12647 of 2025, titled as Kaushlaya Devi Vs. State of Himachal Pradesh & Ors. It has been averred in the application that judgment passed in CWP No.2274 of 2021, titled as Satya Devi Vs. State of Himachal Pradesh & Ors. has been laid challenge by way of SLP (C) No.20496 of 2024 before Hon’ble Apex Court and Hon’ble Apex Court, vide order dated 24.03.2025, has stayed the same, as such, there was no occasion, if any, for this Court to issue directions to the respondents to confer benefit of Satya Devi (supra) and to permit and allow the petitioner to continue in service till she attains the age of 60 years. Learned counsel for the non-applicants/respondents fairly admits factum with regard to filing of SLP (C) as well as stay of the judgment passed by this Court in Satya Devi (supra).
In view of the above, prayer made on behalf of the applicant/petitioner for modification of order dated 01.07.2025 passed in CWP No.12647 of 2025, titled as Kaushlaya Devi Vs. State of Himachal Pradesh & Ors inasmuch as this Court has directed the respondents to permit the petitioner to work till her attaining the age of 60 years, is allowed. Ordered accordingly. Needless to say, benefits, if any, flowing to the petitioner under Satya Devi’s case, shall abide by the outcome of the Special Leave Petition (Civil) Diary No. 11306 of 2025 titled as State of Himachal Pradesh & Ors. Vs. Inder Pal, instituted by the respondents against the common judgment rendered in Satya Devi’s case. December 24, 2025
