ORDER lne urlmlnaI Petition, under Sections 480 and 483 of the Bharat-lya Nagarik Suraksha Sanhita, 2023 [for short, fB.N.S.Sl], is filed on behalf of the petitioner/accused Nos. 1 to 5 seek'lng regular bail in Crime No.201 of 2024 of prakash Nagar Police Station, East Godavari District. 1. 2. Case of the prosecution, in brief, is that on ll.10.2024, at about ll.45 a.m, the Sub Inspector of Police, Prakash Nagar P.S, received credible ®| information about illegal transportation of Ganja. Immediately, Police rushed to the spot and apprehended the Al to A6 and found 21.05 Kgs of Ganja in their possession. The contraband was seized under cover of a mediators report and the Al to A6 were arrested. Thereafter, confessional statements of the I accused were recorded wherein it was revealed that accused also involved in this crime. )
3. Heard. Perused the record. 4. On a perusal of record, it goes to show that quantity of contraband allegedly seized from Al tdp A6 is 21.05 Kgs of ganja. The petitioners have been languishing in jail since ll.10.2024. There are no antecedents with regard to petitioners involving any other cases relating to NDPS Act. 5. On the other hand, the learned Assistant Public Prosecutor submits that major part of the investigation is completed and charge sheet could not be filed, in view of pendency of inventory. 6. ln view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioners/accused No.1 to 5 herein, on the following conditions. (i) The petitioners herein shall be released on their executing a personal bond for Rs.10,000/-(Rupees ten thousand only) each with two sureties for a like sum each to the satisfaction of the II Addit®IOnaI Judicial Magistrate of I class, Rajamahendravaram. ``_--I I---€3 __-i.-I i-=a ``. i=::==:±=±ZE±i| a`L+ I ; ¢ (ii) On release, the petitioners shall appear before the Station House Officer concerned once in a week i.e., on every Sunday between 10.OO a.m. and 05.00 p.m., till filing of the charge sheet. 7.
