PUBLIC PROSECUTOR (AP) The Court made the following: 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 8733/2022 ORDER: The instant petition under Section 482 of the Code of Criminal Procedure, 1973 (in short, “Cr.P.C.”) has been filed by the Petitioners/ Accused Nos. 4 & 5, seeking quashment of the proceedings pending against them in C.C.No.619 of 2024 on the file of 1st Additional Junior Civil Judge- cum-XIth Additional Metropolitan Magistrate, Anakapalli. 2. Heard Sri Ch.Ajay Kumar, learned Counsel for the petitioners, Sri K. Satyanandham, learned counsel for the respondent No.2 and Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State. 3. Learned counsel for the petitioners would submit that the petition may be disposed of without causing any prejudice to the rights and contentions of the petitioners, by dispensing the presence of the petitioners/A4 and A5 before the Trial Court. 4. Learned counsel for the respondent No.2 would submit that the Court may pass appropriate orders. 5. Considering the submissions made, the Criminal petition is disposed of without causing any prejudice to the rights and contentions of the petitioners. However, the presence of the petitioners/A4 and A5 before the Trial Court is dispensed with unless their presence is specifically directed by the Trial Court. 3 However, the petitioners are at liberty to raise all the contentions before the Trial Court in their defence.
