A challenge has been made to the order dated 22.10.2024 passed by learned Metro Magistrate No.9, Jodhpur Metro whereby though an order releasing the vehicle in favour of the petitioner has been passed but with an onerous condition of depositing 50 per cent of the showroom price and seeing the receipt of it. 2. Heard learned counsel for the parties. 3. I am of the view that law does not permit to inflict such a condition as a condition of release, and therefore, the same is not sustainable in eyes of law. 4. Accordingly, the instant misc. petition is allowed in part. The order dated 22.10.2024 is modified to the extent that the deposition of 50 per cent amount of showroom price i.e. Rs.25,56,738/- is struck down and the rest of the conditions of the order shall remain as it it.
