The Petitioner is the Accused No.3. A crime was registered on 09.08.2024 against the Petitioner for the offences under Sections 8 (c) r/w 20 (b) (ii) ( c) and Section 25 of the NDPS Act, 1985. 2. As per the case of the Prosecution, on 24.06.2024, the Sub Inspector of Police, Rolugunta P.S. received information about illegal transportation of Ganja. On securing the mediators, he proceeded and reached near to grove behind Gangalamma Temple at the outskirts of Pedapeta Village and found two persons standing near a bike with while plastic bags. The Police caught them and on search, they found 78 kgs of Ganja. On the confessional statement of the accused, this Petitioner was arrested and was remanded to judicial custody on 21.08.2024. 3. 4. Heard Sri K. Pridhvi Raju, learned counsel for the Petitioner and the learned Assistant Public Prosecutor appearing for the Respondent-State. The learned Assistant Public Prosecutor opposed the bail petition on the ground that the quantity, which was seized from the Petitioner, is a commercial quantity and the investigation is still in progress. 5. 6. Perused the record. 7. According to the learned Assistant Public Prosecutor, the investigation in this case is yet to be completed. Since the investigation is pending and as 3 there is no change in the circumstances, this Court is not inclined to grant bail at this stage. 8. Accordingly, the Criminal Petition is dismissed.
