JUDGMENT(per Hon'ble Sri Justice Ravi Nath Tilhari) Sri Ramineni Sudheer, learned counsel for the appellant has submitted a letter dated 18.02.2025 to the Registrar (Judicial), Andhra Pradesh High Court, on record submitting as follows:
“The Civil Miscellaneous Appeal is filed aggrieved by the orders dated 29.10.2024 in I.A.No.119 of 2023 in O.S.No.32 of 2018 on the file of III Additional District Judge, Ongole. The court below granted temporary injunction in I.A.No.119 of 2023 for a limited period with an opportunity to present the appellants, even after the appellants present before the court below, pending of the present CMA the court below not proceeding with the suit. If the court below not proceed with suit Appellants will be put to irreparable loss and hardship. Considering the same now the petitioners want to withdraw the present CMA. We kindly prays your Hon’ble Registrar pleased to direct the concerned posting section to list the above CMA in the Tomorrow list in the caption of withdrawal. ”
