Hon'ble Manish Kumar Nigam,J. 1. Reply filed by counsel for the petitioner today, is taken on record. 2. Heard learned counsel for the parties and perused the record. 3. This writ petition has been filed for the following reliefs:- "a) issue a writ, order or direction in the nature of mandamus directing to the respondents not to dispossess to the petitioner from his bhumidhari land plot no. 1389M illegally situated in village Khubariyapur Chhibramau, district Kannauj. b) Issue a writ, order or direction in the nature of mandamus directing the respondents to stop the illegal proceedings to damage the crop which was shown in the land in dispute." 4. Instructions were called upon by this Court, which are submitted by learned Standing Counsel and the same are taken on record. 5. The respondents have denied the interference over the land which is recorded in the name of the petitioner over plot No. 1389 M 0.8220 hectares. 6. Contention of learned counsel for the petitioner is that in case, the petitioner has encroached the Gaon Sabha land, the Gaon Sabha may initiate the proceedings under Section 67 of the U.P. Revenue Code, 2006 for the removal of un-authorized encroachment and a direction may be issued to the respondent authorities to initiate the proceedings. 7. Learned Standing Counsel as well as learned counsel for Gaon Sabha have no objection to the said proposition of the counsel for the petitioner. 8. Accordingly, the writ petition is disposed of with direction to the respondents that in case, the petitioner has encroached upon the land of the Gaon Sabha, necessary action be taken under the relevant provisions of the U.P.
