03. In O.S.No.89 of 2010, a money decree was passed on 08.08.2011 as the Judgment Debtor (J.Dr) did not discharge the debt amount. The Decree Holder (D.Hr) filed E.P.No.42 of 2012 on the file of I Additional Junior Civil Judge, Kovvur seeking arrest and detention of the Judgment Debtor (J.Dr) in civil prison for realization of the decree amount and the same was dismissed stating that the Judgment Debtor has no means to discharge the decree amount, challenging the same, this revision petition is filed.
04. After hearing the learned counsel and on perusal of the material available on record, it is seen that, findings of the execution court were written based on the evidence of P.W.1 to 3 and D.W.1. One would notice that there is no perversity in the order passed by the executing Court, to exercise revisional jurisdiction by this Court.
This court finds no merit in the present revision. In the result, this revision petition is dismissed. The D.Hr is entitled to explore all his remedies before appropriate Court.
