Learned counsel for the petitioners submits that the petitioners are aggrieved by the inaction on the part of the respondent-authorities in deciding the pending representation of the petitioner, whereby he is seeking Certificate of Bhumiswami right under the governing Section 246 of the Land Revenue Code, 1959, R/w circular dated 24.09.2018, under the strength of continuing possession since 1933, effective on the date of the code coming into effect i.e. 02.10.1959, therefore he Digitally signed by JYOTI JHA Date: 2025.07.29 11:08:35 +0530
2 prays for a direction to the concerned authorities to decide his representation.

Learned counsel for respondents submits that in view of the limited prayer made by the learned counsel for petitioner seeking direction to respondent-authorities to consider the pending application/ representation, she is having no objection to the limited prayer and if the claim of the petitioner is pending, it will be considered in accordance with law.
3. I have heard learned counsel for the parties and perused the material available on record.

Considering the facts and circumstances of the case instead of keeping this petition pending, I find it appropriate to dispose of the same at this stage directing the petitioner to file a fresh representation along with all relevant documents to the concerned authorities within a period of 15 days from the date of receipt of copy of this order and in-turn the respondent-authorities is directed to consider/decide the representation of the petitioner on its own merits in accordance with law as expeditiously as possible after providing opportunity of hearing to the petitioner.
5. It is made clear that this Court has not observed anything on the merits of the case.
