Such prayer is not opposed by Shri Lal Mani Singh, learned counsel for the respondent. The appellant is consequently permitted to withdraw the special appeal and also the writ petition with liberty to approach the labour court/ industrial court. Accordingly, present special appeal and the writ petition are dismissed as withdrawn, with the liberty, as prayed.
